Skilled Independent Subclass 189

This points-based visa is for skilled workers who are not sponsored by an employer, a state or territory, or a family member. With this visa, you can live and work permanently anywhere in Australia and eligible family members can be included in your application. This is a permanent visa and allows visa-holders to remain in Australia indefinitely with full work rights.

To be able to submit a valid application for this visa you need to first submit an Expression of Interest through SkillSelect. You can do this in or outside Australia.

APPLICATION CONDITIONS

Applications are by invitation only. To be invited to apply, you must:

  • have experience in a nominated occupation on Australia’s Eligible Occupations List, AND;
  • have a skills assessment with the relevant assessing authority for that occupation
  • submit an Expression of Interest
  • be older than 18 and less than 45 years of age when the invitation is issued
  • meet general Skilled Migration basic requirements, including English language, health, and character checks
  • be able to score at least 65 on the points test and highest points ranked applicants will e prioritized .

Skilled Nominated Subclass 190

This category is for people who highly skilled and have education, skills and employability which will contribute to the Australian economy, and are willing to settle in States and Territories where their skills are in demand.

TO APPLY FOR THIS CATEGORY YOU MUST:

  • satisfy the basic requirements;
  • nominate a skilled occupation from the Skilled Occupations List
  • score at least 65 points; and (Subject to change)
  • be nominated by a participating State or Territory.

Participating States and Territories select nominees to meet a skill shortage in their area.The State or Territory is not the employer. However, as a shortage of skills has been identified, it is anticipated a job may be found quickly.This visa allows you to migrate to Australia if you have good English language skills and have skills and qualifications in an occupation in need in Australia.

This visa uses a points test to select visa applicants with characteristics needed in the Australian labor market.You must be sponsored by an eligible relative living in Australia or obtain nomination from a participating State or Territory government agency.

WHAT DOES THIS VISA LET YOU DO?

This visa allows you and any secondary applicants included in your visa application to live as permanent residents in Australia.Australian permanent residents can:

  • Live and work in Australia on a permanent basis
  • Study in Australia at school or university
  • Receive subsidized healthcare through Medicare and the Pharmaceutical Benefits Scheme (PBS)
  • Access certain social security payments (subject to waiting periods)
  • Be eligible for Australian citizenship (subject to the residency eligibility criteria)
  • Sponsor people for permanent residence.

Skilled Regional Provisional Subclass 489

Migration to Australia under the Skilled Regional Provisional visa requires successful applicants to live in designated regional areas as a condition of their visa.

Applicants have the opportunity to immigrate to Australia on the basis of their skills and/or educational background.To be eligible, the SRPV, visa applicant must be sponsored by an Australian State/territory or from a eligible relative who resides in regional Australia .The applicant must also meet the points test minimum pass mark, which is currently 65 points (Subject to change)

Please note that applicants who are nominated by a state or territory authority will be eligible for an additional 10 points under the skilled migration points test where applicant needs to get only 60 points from the mandatory eligibility factors.

DURATION

The visa entitles people immigrating to Australia to gain temporary residence. It is a 4 years provisional visa, for skilled workers who are unable to meet the criteria for a Skilled Independent visa.

On this visa you will have the opportunity to apply for permanent residency after you have lived in Australia for two years and worked for at least 12 months in a specified regional area. The work you undertook should be a professional level (not odd jobs) , full time or full time equivalent ,paid job to qualify for the PR scheme.

ELIGIBILITY CRITERIA

Age:- Applicants must be under 45 years old.

English Language:- General skilled migration to Australia applicants must have sufficient English language ability and IELTS is must for this process.

Skills & Qualifications:- The main applicant must meet the qualifications and/or work experience requirements of the appropriate skills assessing body for their profession and must have been assessed as suitable by the relevant body for the nominated occupation;

Must nominate a skilled occupation that appears on the most recent version of the Skilled Occupations List;

Sponsorship Requirements:- If you are thinking of applying for a Skilled Nominated (Provisional) visa (subclass 489), there are a couple of important things you must remember:

  • This visa is a four year provisional visa where you and your dependants must live in a regional area for two years and work full time for 12 months(min 35 hours a week) to meet the criteria for permanent residency.
  • Once criteria has been met, you can lodge an application for permanent residency through visa subclass 887.

Employment can be undertaken in the following ways

  • Work for one or more employers
  • Two part time jobs
  • Be self-employed/own your own business.

What are the sponsorship bodies

Applicant needs to obtain the sponsorship from one of the State Territory Authorities mentioned below. ACT ,South Australia ,Northern Territory ,Tasmania ,Victoria ,Queensland, New South Wales,Western Australia

Health & Character

Australia has strict health and character requirements that must be met before any permanent visa of more than 12 months will be granted. People attempting skilled migration to Australia will be required to:

  • Undergo a medical examination and chest x-ray undertaken by one of a panel of doctors selected by the Australian authorities, and;
  • Obtain police certificates for all countries in which you have lived for more than 12 months in the 10 years leading up to the application.

Processing Times

The current processing time for the SRS visa process would be minimum 6-9 months .

Once the applicant starts the process officially with CDC, they will be offered a comprehensive settlement kit ,which provides details on lifestyle, accommodation, real state ,Medicare, Insurance, schools and other important details about Australia.

  • Once criteria has been met, you can lodge an application for permanent residency through visa subclass 887.

Employment can be undertaken in the following ways:

  • Work for one or more employers
  • Two part time jobs
  • Be self-employed/own your own business.

So where can I live and work?

You and your dependants (anyone on your visa) cannot live, work or study in major cities in Australia. The allowed postcodes for your family will be clearly indicated in your visa grant letter.

Do I have to stay in the same region where I got the state nomination and if I break that rule what will happen?

If the applicant decides to move interstate within the first 2 years, his file will be marked ‘ did not meet signed obligations’; by the nomination authority .If they are contacted by DIBP, they will also be informed that the 190 /489 obligations were not met unless the nomination authority has approved the interstate movements based on reasonable circumstances.

Can I work in major cities after meeting my 489 requirements even though I have not applied or been granted permanent residency?

No, you cannot work in a non-regional area while you are holding a 489 visa, even if you have met the two years residency and 12 months employment criteria. If you are caught living, working or studying outside of a regional area you can lose your visa.
